Try-on Privacy & Biometric Notice
This notice explains what happens with your photo when you use the try-on in a shop that works with FitWear. In short: your photo is used only to create your try-on image and is deleted right after.
1. Who is responsible
The shop where you use the try-on offers it on its website; FitWear (Kosovo) provides and runs it on the shop's behalf. You can contact either of them; for FitWear write to [email protected].
2. What we process
- The photo you upload or take with the camera.
- The product photos and the product page you are on.
- The generated try-on image(s).
- Time of the try-on, your consent (which version of these terms you accepted) and technical data such as your IP address in server logs.
- A one-way fingerprint (SHA-256 hash) of the photo file, so the shop can count how many different people used the try-on. The photo cannot be recreated from it.
We do not ask for your name or e-mail for a try-on, and we do not combine try-ons with advertising profiles.
3. Why and on what basis
Only to create and show your try-on image, to count usage for the shop and to prevent abuse. The legal basis is your consent, which you give by ticking the box before the try-on. You can stop at any time simply by not using the try-on; withdrawing consent does not affect try-ons already made.
4. Face images and biometric data
- Your photo shows your face. To create the try-on image, an AI model analyses your face in that photo. Neither FitWear nor the shop creates or stores a face template, face-recognition profile or biometric identifier, and we never use your photo to identify you.
- Because some laws treat face images as biometric data (for example the GDPR in the EU, the Illinois Biometric Information Privacy Act or the Texas Capture or Use of Biometric Identifier Act in the USA), we ask for your explicit consent first and follow this retention schedule:
- The visitor's photo (portrait) is deleted as soon as the try-on finishes - also when it fails - and any copy left behind by an interruption is removed automatically within 2 hours. Generated try-on images are deleted automatically after 30 days.
- We never sell, rent, trade or otherwise profit from your photo or any data derived from it.
5. AI providers
To generate the image, your photo and the product photo are sent over an encrypted connection to an AI provider: Meta Platforms (Meta Model API, model "Muse Image") or, as a backup, fal.ai, which runs the same model. They are located in the United States. We use the providers' standard (non-training) service: under their terms, your photo is not used to train their AI models. The providers may keep request data for a limited time under their own terms to operate the service and prevent abuse. Details: Subprocessors.
6. Who sees your images
- You see the generated image in the shop's page.
- The shop and authorised FitWear staff can see generated images in their dashboards (for statistics and support) - never your original photo.
- Generated images are stored at long random links that cannot be guessed; anyone you send such a link to can open it until the image is deleted.
7. On your device
The widget remembers in your browser that you accepted these terms and which product photos you already tried on in this tab. See Cookies & Local Storage.
8. Your rights
You can ask for information, deletion of generated images, restriction or object, and you can complain to the Information and Privacy Agency of the Republic of Kosovo (Agjencia për Informim dhe Privatësi) or your local data protection authority. Write to [email protected] and, if possible, include the shop and the time or the image link. Full details: Privacy Policy.
9. Adults only
The try-on is only for people aged 18 or older. Do not upload photos of children.
